California Beta - Version 1.0
August 29, 2026
These Platform Terms of Service ("Terms") govern access to and use of the BLUNA website, applications, communications, job-coordination tools, and related services (collectively, the "Platform") operated by BLUNA LLC, a California limited liability company, operating the BLUNA beta platform ("BLUNA"). The California beta is offered only for business and professional property-service activity in California.
BY CREATING AN ACCOUNT, CHECKING THE REQUIRED ACCEPTANCE BOX, OR ACCEPTING A JOB QUOTE OR JOB OFFER THAT EXPRESSLY INCORPORATES THESE TERMS, YOU AGREE TO THESE TERMS. IF YOU ACT FOR A COMPANY OR OTHER ENTITY, YOU REPRESENT THAT YOU HAVE AUTHORITY TO BIND THAT ENTITY. DO NOT USE THE PLATFORM IF YOU DO NOT AGREE.
1.1 Property Customer. A "Property Customer" is the person or entity that contracts with BLUNA on the property side for a Job. The primary California beta path is an individual property manager acting in that person's business or professional capacity. The same Property Customer role also covers: (a) a property owner acting directly for a rental, investment, or professionally managed property; and (b) a property-management company or other entity acting for an owner. The account and each accepted Quote must identify the actual contracting Property Customer. Billing duties, representations, warranties, and responsibility for authority, resident coordination, Job Photos, and lawful access attach to that contracting party.
1.2 Vendor. A "Vendor" is a separate property-service business or service provider that uses the Platform to consider and perform Jobs. A Vendor has no authority to bind BLUNA or a Property Customer unless a written authorization expressly says otherwise.
1.3 Residents are not Platform parties. Residents, occupants, tenants, and guests are not Platform users or parties to a Job contract in this beta. Property Customers, not BLUNA or Vendors, are responsible for resident-facing notices, permissions, scheduling, and lawful access. Vendors must not use resident contact information to communicate directly with residents in the California beta. Any later product change that permits direct resident communications requires a documented workflow and an update to the applicable Platform terms, privacy disclosures, and implementation controls before launch.
1.4 California-only. The beta is not offered for Jobs outside California. A user must not route an out-of-state Job through the beta without BLUNA's written approval and separate legal review.
2.1 Managed coordination and administration. For the beta, BLUNA operates a managed coordination and administrative service platform. Depending on the Job, BLUNA may receive a service request, gather scope information, coordinate or identify a Vendor, present or administer a Quote, maintain communications and Job records, collect Job payments, administer Vendor payout, and facilitate rework or dispute handling.
2.2 Underlying field work. Unless a Quote expressly states otherwise, BLUNA does not itself undertake the underlying painting, cleaning, repair, maintenance, turnover, or other field service. The Vendor accepting a Job is responsible for performing the field work and for the acts and omissions of its personnel. Nothing in these Terms is a legal conclusion about worker classification, occupational licensing, contractor licensing, or any payments-regulatory status. Those matters depend on applicable law and facts beyond these Terms.
2.3 No property-management authority. BLUNA does not exercise the Property Customer's landlord, owner, leasing, screening, rent-setting, eviction, or resident-management authority. The Platform must not be used to make or implement resident eligibility, rent, eviction, retaliation, discrimination, harassment, or surveillance decisions.
3.1 Accurate account information. Each user must provide accurate, current information and keep it updated. Property Customers must identify the person or entity responsible for each Job and payment. Vendors must provide the business, tax, payout, credential, and insurance information required by onboarding or applicable law.
3.2 Authority. A Property Customer represents for each Job that it owns the property or has sufficient authority from the owner to order the services, authorize access, provide Job Data, approve charges, and give BLUNA and the Vendor the instructions necessary to perform the Job. A user accepting for an entity represents that the acceptance binds that entity.
3.3 Account security and Restricted Access Data. Users must protect login credentials, restrict account access to authorized personnel, and promptly notify BLUNA of suspected compromise. Lockbox codes, gate codes, alarm details, key-location information, and similar unit-access instructions are "Restricted Access Data." They must be shared only through designated access fields and only when reasonably necessary for an authorized Job. Users must not place Restricted Access Data in ordinary chat, AI prompts, notes, or other free-form fields unless BLUNA expressly designates that field for secure access information.
4.1 Service Request. A request submitted through the Platform is a request for coordination, not a guaranteed Job or fixed price. BLUNA may request photographs, dimensions, site facts, access information, or other details reasonably needed to scope the work.
4.2 Quote. A "Quote" is the job-level offer presented to the Property Customer. It must identify at least the property, material scope, Job Price or pricing method, material assumptions, material exclusions, and any separately disclosed cancellation, diagnostic, mobilization, materials, or reimbursement terms. A Quote may identify a specific Vendor or allow BLUNA to assign or reassign a qualified Vendor consistent with the accepted scope.
4.3 Property Customer approval. A Job becomes authorized when the Property Customer takes the affirmative electronic action identified on the Quote acceptance screen. Approval authorizes BLUNA to coordinate the Job and to initiate charges only as stated in the Quote, approved Change Orders, and these Terms.
4.4 Vendor acceptance. A Job becomes committed to a Vendor when the Vendor affirmatively accepts the Job offer or assignment presented through the Platform. Before acceptance, the Vendor must be able to see the material scope, location information reasonably necessary to evaluate the Job, expected timing, and the Vendor Payout or payout formula.
4.5 No reliance on oral changes. Material changes to price, scope, materials, timing, or payment must be captured in the Platform or another written electronic record accepted by the affected party.
The Property Customer is responsible for the following for each Job:
A Vendor accepting a Job is responsible for the following:
7.1 Scope control. A Vendor must not materially expand the Job or incur a charge to the Property Customer beyond the accepted Quote without an approved Change Order, except for an immediate safety step reasonably necessary to prevent imminent injury or material property damage. Any such safety step must be reported promptly and does not automatically entitle the Vendor to an undisclosed charge.
7.2 Change Orders. A Change Order must identify the additional or reduced scope, price effect, material timing effect, and any materials or reimbursement effect. The Property Customer must affirmatively approve a price-increasing Change Order before the additional charge is incurred, except where applicable law allows otherwise.
7.3 Materials. Each Quote must state whether materials are included in the Commissionable Job Price or are separately reimbursable. Unless the Quote expressly states otherwise, separately itemized, pre-approved, documented third-party material reimbursements are treated as pass-through reimbursements and are not part of the Commissionable Job Price. A Vendor may not mark up or substitute a separately reimbursable item unless the Quote or Change Order expressly allows it.
7.4 Receipts and returns. A Vendor seeking separate reimbursement must provide commercially reasonable documentation. Credits or refunds received for returned reimbursed materials must be passed through to the Property Customer through the Platform, net only of a separately disclosed and accepted handling charge, if any.
8.1 Completion record. A Vendor must mark a Job complete only when the accepted scope is substantially complete and must provide the closeout evidence required by the Quote or Platform, which may include before-and-after Job Photos, notes, measurements, receipts, and identified exceptions.
8.2 Property Customer review. A Property Customer should report a material scope or quality concern through the Platform promptly after discovery and provide enough detail to permit review. Delay may limit BLUNA's practical ability to investigate but does not waive a nonwaivable right.
8.3 Rework. BLUNA may facilitate reasonable rework, replacement, credit, partial refund, or other Job-specific resolution. A Vendor must reasonably cooperate with documented rework related to the Vendor's deficient or incomplete performance. BLUNA may consider the Quote, Job Data, photographs, communications, receipts, and other reliable records when administering a resolution.
8.4 No guarantee of result. BLUNA does not guarantee that a Vendor will achieve an aesthetic, diagnostic, repair, or durability result not expressly stated as an accepted Job requirement. Any Vendor warranty expressly stated in a Quote remains the Vendor's responsibility unless the Quote expressly states a separate BLUNA obligation.
9.1 Property Customer cancellation. A Property Customer may request cancellation through the Platform. BLUNA may charge only a cancellation, diagnostic, mobilization, nonreturnable-material, or similar amount that was clearly disclosed and affirmatively accepted for that Job before the charge-triggering commitment occurred, plus approved nonrecoverable third-party costs. If no such amount was disclosed and accepted, BLUNA will not impose an automatic blanket cancellation fee under these Terms.
9.2 Vendor withdrawal before acceptance. A Vendor may decline a Job before acceptance without a Job-level penalty, subject to reasonable account-management rules against manipulation or abuse.
9.3 Vendor cancellation after acceptance. If a Vendor cannot perform an accepted Job, the Vendor must notify BLUNA promptly and provide accurate status. BLUNA may reassign the Job and may limit, suspend, or terminate the Vendor's Platform access for repeated or material accepted-Job abandonment. Version 1.0 does not impose an automatic monetary penalty for Vendor abandonment unless a specific future program rule or Job offer clearly discloses the amount and trigger before Vendor acceptance and is separately reviewed for legality.
9.4 Safety or access failure. BLUNA or a Vendor may pause or cancel performance if lawful access is unavailable, conditions are materially unsafe, required authority is disputed, or the actual scope materially differs from the accepted Quote. Charges, if any, are governed by the accepted Quote and Section 9.1.
10.1 Job Price. The "Job Price" is the total amount payable by the Property Customer under the accepted Quote and approved Change Orders, including any separately stated taxes, fees, or reimbursements. The "Commissionable Job Price" is the Job Price excluding taxes, refunds or credits, and separately itemized approved pass-through reimbursements unless the Quote expressly includes an item in the commission base.
10.2 BLUNA commission. Unless a Quote expressly states another arrangement, BLUNA retains a platform commission equal to 30% of the Commissionable Job Price. The Vendor Payout equals the remaining 70% of the Commissionable Job Price, plus approved noncommissionable pass-through reimbursements, less valid refunds, credits, chargebacks, reversals, payout adjustments, and amounts otherwise expressly authorized by these Terms or the accepted Quote.
10.3 Property Customer payment authorization. By accepting a Quote or Change Order, the Property Customer authorizes BLUNA and its payment processor to charge the payment method associated with the account for the accepted amount when the Platform states the charge will occur, including an accepted milestone, completion event, or other disclosed trigger. BLUNA may validate the payment method or seek an authorization hold only if the checkout flow discloses that practice.
10.4 Stripe. BLUNA uses Stripe or an affiliated Stripe service for payment processing and Vendor payout administration. Users may be required to provide information directly to Stripe and accept Stripe terms applicable to their account. The exact technical configuration may change without amending these Terms if the contractual rights, charge triggers, refund rules, and responsibility allocations presented to users do not materially change. These Terms do not state or decide which party is the merchant of record or any regulated payments status.
10.5 Vendor payout timing. BLUNA will display or otherwise communicate the expected Vendor payout status or timing. A displayed estimate is not a guarantee of bank availability. BLUNA may delay or adjust a Vendor payout for a documented reason reasonably related to an incomplete Job, unresolved rework or dispute, refund or chargeback exposure, suspected fraud, processor restriction, legal requirement, account deficit, or incorrect payout information. BLUNA will not withhold payout arbitrarily or use payout holds as an undisclosed penalty.
10.6 Refunds and credits. BLUNA may issue a refund or credit consistent with the accepted Quote, a documented Job resolution, applicable law, or a payment-processor requirement. If a refund or credit relates to Vendor performance, the corresponding Vendor Payout may be reduced, offset, or recovered to the extent supported by the Job record and these Terms.
10.7 Chargebacks. A Property Customer should use the Platform dispute process before initiating a payment dispute when reasonably practicable. A chargeback does not determine the contractual merits of a Job dispute. BLUNA may provide the processor with relevant transaction and Job records and may recover from a Vendor a chargeback amount attributable to the Vendor's performance, fraud, unauthorized conduct, or breach, to the extent supported by the record and permitted by law.
10.8 Taxes. Each user is responsible for taxes legally imposed on that user. BLUNA may collect, report, or remit taxes when legally required. Vendor tax reporting information must be accurate and current.
11.1 Job Data. "Job Data" includes property addresses; unit or area identifiers; Restricted Access Data; before-and-after Job Photos; measurements; paint colors; bulb counts and types; appliance type, manufacturer, and model information; flooring type; technician notes; materials; property condition, repair, and maintenance history; service history; communications; and related records submitted to or generated through the Platform for a Job.
11.2 Necessary-data rule. Users must submit only Job Data reasonably necessary for scoping, lawful access, performance, documentation, payment, future service history, support, safety, security, or dispute handling. Users must not intentionally upload Social Security numbers, government identification, medical records, financial records, resident screening information, account credentials, private resident communications, or other unrelated resident information. A user that discovers unnecessary resident information in a Job record should report it through the Platform so BLUNA can redact or delete it where appropriate.
11.3 Job Photos and incidental resident capture. Job Photos should focus on the work area, condition, progress, and completion. Users must avoid photographing identifiable people, minors, family photographs, mail, identification, medical or financial papers, computer screens, or unrelated personal effects unless genuinely necessary to document an authorized incident or condition and legally permitted. BLUNA may use automated tools to detect, blur, redact, or crop faces, personal photographs, documents, screens, or similar identifying content before a Job Photo becomes a long-term retained Platform record. A Vendor must not use Job Photos for marketing, portfolios, social media, facial recognition, resident profiling, or any purpose outside the Job without separate written authorization from BLUNA and the Property Customer and any other legally required permission.
11.4 Restricted Access Data. Lockbox codes, gate codes, alarm instructions, key records, and similar credentials are high-risk security information. BLUNA will limit their display to authorized personnel with a current Job need and, where implemented, may use short display windows, technician-identifying watermarks, role-based access, and access-event logging that does not record the credential value. Users must not attempt to defeat those controls. BLUNA will not intentionally place Restricted Access Data in ordinary analytics, general exports, marketing systems, or general-purpose AI prompts. The credential value will be removed from ordinary access when the access window or Job need ends and is scheduled for deletion as soon as operationally practicable and in all events within 24 hours after Job closeout, cancellation, or reassignment, except where a specific security incident or legal-preservation obligation requires narrower retained evidence. Non-secret access audit records may be retained longer under the Privacy Policy.
11.5 Platform license. Each user grants BLUNA a nonexclusive, worldwide, royalty-free license during the relationship and for the applicable retention period to host, copy, transmit, organize, display to authorized Job participants, analyze, and otherwise use Job Data solely to operate, secure, support, document, and improve the Platform; administer current and future Jobs and payments; maintain authorized property service history; resolve disputes; create permitted deidentified or aggregated information; and comply with law and the Privacy Policy. This license does not authorize BLUNA to use identifiable resident personal information or Restricted Access Data for unrelated marketing, resident profiling, or general-purpose AI training.
11.6 Resident personal information and identifiable photographs. BLUNA will not sell or share for cross-context behavioral advertising identifiable resident personal information or Job Photos in the California beta and will not use identifiable resident personal information or identifiable Job Photos to train a general-purpose AI model. Incidental resident information captured in a Job Photo is subject to the minimization, blurring/redaction, deletion, and retention rules in the Privacy Policy. A Property Customer must not instruct BLUNA to use resident information for a purpose inconsistent with those restrictions.
11.7 Property records; deidentified and nonpersonal building information. BLUNA may maintain address/unit-linked property and service records for authorized future service, estimating, maintenance history, quality, and support during the retention period in the Privacy Policy. Subject to applicable privacy law and contractual restrictions, BLUNA may also create and use aggregated, deidentified, or nonpersonal building information, including paint colors, appliance makes and models, bulb counts/types, flooring type, fixture types, materials used, generalized service history, and property-condition attributes, for analytics, service improvement, benchmarking, pricing operations, quality assurance, and AI-assisted Platform functions. Before cross-customer analytics or model use, the deidentified dataset must exclude Restricted Access Data, resident names/contact details, identifiable resident imagery, and address/unit identifiers or other data reasonably capable of linking the record back to a particular consumer or household. BLUNA will not attempt to reidentify information treated as deidentified and will maintain measures reasonably designed to prevent reidentification.
11.8 Retention. BLUNA applies the category-specific retention schedule in the Privacy Policy. For the beta, the default is: (a) Restricted Access Data only for the active access need and deletion within 24 hours after Job closeout, cancellation, or reassignment; (b) original unredacted Job Photos for 30 days after Job closeout, unless a documented dispute, rework, security incident, chargeback, insurance claim, or legal hold requires temporary preservation through resolution plus 90 days; (c) blurred/redacted Job Photos and address/unit-linked property service history for the active relationship and five years after the last related Job; and (d) longer retention of deidentified building attributes where the deidentification requirements remain satisfied. Other categories follow the Privacy Policy and applicable legal or accounting requirements.
11.9 Resident notice and authority. The beta does not require a resident to create a BLUNA account or provide a separate BLUNA click-through merely because an authorized Job Photo may incidentally capture personal belongings. The Property Customer remains responsible for providing any legally required resident entry, photography, privacy, or property-management notice and obtaining legally required permission. If BLUNA later begins collecting information directly from residents or communicating with residents, BLUNA must update the applicable notice, consent, privacy, and product controls before that feature is released.
Use of the Platform is subject to the BLUNA Privacy Policy. When a Property Customer qualifies as a "business" under the California Consumer Privacy Act (CCPA) and BLUNA processes California personal information on that Property Customer's behalf as a service provider or contractor, the BLUNA California Data Processing Addendum ("DPA") is incorporated into these Terms for that processing. Data BLUNA processes for its own account administration, billing, security, fraud prevention, legal compliance, and independent Platform operations remains governed by the Privacy Policy and applicable law.
13.1 Operational messages. BLUNA may send in-app, email, and, only where the user has provided applicable consent, SMS communications about account verification, Job scheduling, access coordination, status, completion, payment, payout, security, or support. Operational SMS consent is not consent to marketing texts.
13.2 SMS opt-out. Where reply texting is available, a user may reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, or use another reasonable method that clearly communicates revocation. BLUNA will honor valid revocation requests within the time required by applicable law. A one-time nonmarketing confirmation may be sent. Users remain responsible for keeping an email or in-app channel available for required account and Job notices.
13.3 No marketing SMS in beta. BLUNA will not use the beta operational-SMS consent for advertising or telemarketing. Any future marketing-SMS program requires a separate enrollment flow and legal review before launch.
13.4 AI disclosure. A BLUNA feature identified as AI-assisted, automated, or a bot may generate or summarize information and may make errors. Users must review outputs before relying on them for a Job. Users must not submit unnecessary resident personal information, confidential access credentials, or sensitive data into a free-form AI field.
13.5 Human control and housing decisions. AI-assisted features in the beta may help organize, summarize, route, or draft operational information, but BLUNA will not use an AI or automated system to make a decision that provides or denies housing to a resident or determines resident eligibility, rent, eviction, retaliation, or a comparable resident right. A material operational decision affecting a Job remains subject to human review where reasonably necessary.
13.6 No resident chatbot. The beta chatbot or AI support feature, if any, is for Property Customers and Vendors, not direct resident interaction. A bot must be clearly identified as automated or AI-assisted when the feature communicates autonomously with a user.
Users must not:
BLUNA may suspend or terminate access for material or repeated breach, fraud, security risk, unlawful activity, repeated accepted-Job abandonment, failure to maintain required onboarding credentials, payment default, processor restriction, or conduct creating material safety or Platform risk. Where practicable, BLUNA will provide notice and a reasonable opportunity to address a curable issue. BLUNA may act immediately where delay would create material risk or violate law or processor requirements.
A user may stop using the Platform and request account closure subject to open Jobs, payment obligations, record-retention requirements, and other surviving provisions. Closing an account does not extinguish accrued payment, refund, indemnity, confidentiality, data-protection, or dispute obligations.
The Platform, software, workflows, branding, and BLUNA content are owned by BLUNA or its licensors. Subject to these Terms, BLUNA grants each user a limited, nonexclusive, nontransferable, revocable right to use the Platform for authorized beta activity. Users retain ownership of content they own and grant only the licenses stated in these Terms and the Privacy Policy. Feedback may be used by BLUNA without restriction or compensation, provided BLUNA does not disclose the user's confidential information in doing so.
Each party must protect nonpublic business, pricing, access, security, resident, and Job information received through the Platform using reasonable care and may use it only for the relationship and authorized Jobs. This restriction does not apply to information lawfully public without breach, independently developed, rightfully received without duty, or required to be disclosed by law. Where legally permitted, the receiving party should provide reasonable advance notice of compelled disclosure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ON AN "AS AVAILABLE" BASIS. BLUNA DOES NOT WARRANT UNINTERRUPTED PLATFORM ACCESS, THAT A VENDOR WILL ACCEPT A PARTICULAR JOB, OR A RESULT NOT EXPRESSLY STATED IN AN ACCEPTED QUOTE. BLUNA DOES NOT PROVIDE LEGAL, INSURANCE-COVERAGE, TAX, ENGINEERING, ARCHITECTURAL, CONTRACTOR-LICENSING, OR WORKER-CLASSIFICATION ADVICE THROUGH THE PLATFORM. NOTHING IN THESE TERMS DISCLAIMS AN EXPRESS OBLIGATION BLUNA ASSUMES IN AN ACCEPTED QUOTE OR A LIABILITY THAT CANNOT LAWFULLY BE DISCLAIMED.
19.1 Vendor. To the extent permitted by law, Vendor will defend and indemnify BLUNA and its officers, managers, and personnel from third-party claims, losses, damages, and reasonable defense costs to the extent arising from Vendor's field services; Vendor's personnel; Vendor's breach of these Terms; Vendor's unlawful, unsafe, or unauthorized conduct; Vendor-provided content; or Vendor's failure to maintain a legally required license, permit, or insurance. This obligation does not require Vendor to indemnify a person for that person's fraud, willful misconduct, or negligence to the extent an indemnity is prohibited by California law, including any applicable construction-indemnity limitation.
19.2 Property Customer. To the extent permitted by law, Property Customer will defend and indemnify BLUNA and its officers, managers, and personnel from third-party claims, losses, damages, and reasonable defense costs to the extent arising from Property Customer's lack of authority to order or provide access for a Job; failure to give legally required resident notices or obtain legally required permissions; inaccurate access or hazard instructions; unlawful use of the Platform; Property Customer-provided content; or breach of these Terms. This obligation is subject to the same nonwaivable-law limitations stated above.
19.3 Procedure. The indemnified party must provide reasonably prompt notice, allow the indemnifying party reasonable control of defense and settlement, and reasonably cooperate at the indemnifying party's expense. No settlement may admit fault by or impose a nonmonetary obligation on an indemnified party without that party's written consent.
20.1 Excluded damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER BLUNA NOR A PLATFORM USER WILL BE LIABLE TO THE OTHER UNDER THESE TERMS FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS OR LOST BUSINESS OPPORTUNITY, ARISING FROM THE PLATFORM OR A JOB, EVEN IF ADVISED OF THE POSSIBILITY, EXCEPT TO THE EXTENT SUCH A LIMITATION IS PROHIBITED BY LAW OR THE DAMAGES RESULT FROM A PARTY'S FRAUD, WILLFUL MISCONDUCT, BREACH OF CONFIDENTIALITY OR DATA-PROTECTION DUTIES, INFRINGEMENT OR MISAPPROPRIATION, OR INDEMNIFICATION OBLIGATIONS.
20.2 BLUNA cap. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUNA'S AGGREGATE LIABILITY TO A USER ARISING FROM THESE TERMS AND ALL JOBS DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM WILL NOT EXCEED THE GREATER OF (A) THE BLUNA COMMISSION ACTUALLY RETAINED FROM THAT USER'S JOBS DURING THAT SIX-MONTH PERIOD OR (B) $1,000. THIS CAP DOES NOT APPLY TO BLUNA'S FRAUD, WILLFUL MISCONDUCT, OR LIABILITY THAT CALIFORNIA LAW DOES NOT PERMIT TO BE LIMITED.
20.3 Payment obligations. Nothing in this Section limits a Property Customer's obligation to pay valid accepted charges or a Vendor's obligation to return an overpayment, refund, or recoverable chargeback properly allocated under these Terms.
California law governs these Terms without regard to conflict-of-laws rules. The parties will first attempt in good faith to resolve a dispute through the Platform support process or written business escalation. If a dispute is not resolved, each party consents to the exclusive jurisdiction of the state and federal courts located in the California county where BLUNA maintains its principal place of business when the action is filed, except where applicable law requires another forum. Nothing in this Section prevents a party from seeking temporary or injunctive relief where legally available.
BLUNA may update these Terms. For a material change, BLUNA will provide conspicuous notice and require renewed affirmative acceptance before the change governs a new Job or otherwise becomes binding where renewed assent is legally appropriate. Nonmaterial administrative changes may be posted with an updated version date. An accepted Quote is governed by the version presented for that Quote unless the parties expressly agree otherwise.
These Terms, the accepted Quote and Change Orders, the Privacy Policy, and any applicable DPA or expressly incorporated policy form the agreement for the Platform relationship and applicable Job. If a Quote conflicts with these Terms on a Job-specific commercial term, the Quote controls for that Job. A waiver must be express and applies only to the stated instance. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder remains effective. A user may not assign these Terms without BLUNA's consent, except in connection with a permitted sale or reorganization that assumes all obligations; BLUNA may assign them in connection with a reorganization, financing, sale, or transfer of the Platform business. Sections that by their nature should survive termination will survive.
Questions about these Terms or a Job may be submitted through the Platform support channel or by email to casey@bluprnts.io. Privacy requests should identify "Privacy Request" in the subject line and are handled under the Privacy Policy.
